Welcome to Papilio Art. We operate as a Sole Trader in England and Wales. These Terms and Conditions, alongside our Privacy Policy below, govern your use of www.papilioart.co.uk and the purchase of any artwork, prints, or merchandise from our online store.
By accessing the Site or making a purchase, you agree to these terms. If you do not agree, please do not use our Site.
PART 1: TERMS & CONDITIONS OF SALE

2. Intellectual Property & Copyright
Ownership: All artwork, designs, paintings, photographs, text, and graphics on this Site are the exclusive intellectual property of Stephen Perrett / Papilio Art and are protected by UK and international copyright laws.
No Transfer of Rights: The purchase of any physical product (including paper, canvas, or aluminium prints, and merchandise like t-shirts) does not transfer any copyright, reproduction, or commercial modification rights to the buyer.
Prohibited Use: You may not copy, scan, reproduce, digitally alter, resell, or exploit any artwork or designs for commercial purposes. This includes print-on-demand services, commercial printing, or training artificial intelligence (AI) models.
3. Products, Descriptions, and Gelato Fulfilment
Fulfilment Partner: Our prints and merchandise are manufactured, fulfilled, and shipped on demand by our trusted partner, Gelato.
Product Variations: We make every effort to display product colours, textures, and details accurately. However, because digital screens display colours differently, we cannot guarantee that your monitor's display will perfectly match the physical product
4. Pricing and Payment
All prices are listed in GBP (£) and are subject to change without notice.
Payments are processed securely via Squarespace's integrated payment gateways (Stripe and/or PayPal). We do not store or have access to your credit card details.
Import Duties and Customs: If you are ordering from outside the United Kingdom, you are solely responsible for paying any local customs duties, import VAT, or clearance fees incurred upon delivery.
5. Shipping and Delivery
Production Times: Because items are produced on demand by Gelato to reduce waste, orders typically take 3-7 business days to print and pack before dispatch.
Delivery: We are not liable for transit delays caused by postal carriers, customs processing, or incorrect shipping addresses provided by the buyer.
6. Cancellations, Returns, and Refunds
Custom/On-Demand Production: Because all items are custom-printed to order via Gelato, we do not accept returns, exchanges, or cancellations for change of mind or incorrect size selection. Please review sizes carefully before ordering.
Damaged or Misprinted Items: If your order arrives damaged, defective, or misprinted, please contact us at hello@papilioart.co.uk within 14 days of delivery. Please include clear photos of the damaged item and the packaging. We will arrange a free replacement or a full refund.
7. Limitation of Liability
To the maximum extent permitted by English law, Papilio Art shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site or the purchase of any products. Our total liability to you for any claim arising out of your purchase shall not exceed the total price paid for the product.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
PART 2: PRIVACY POLICY (UK GDPR COMPLIANT)
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from the Site. We act as the Data Controller for your personal data.

Note: We never see or store your raw payment details. Payments are handled securely by third-party processors (Stripe/PayPal).

Gelato: We share your name, shipping address, phone number, and ordered item details with Gelato strictly for the purpose of printing and shipping your products.

We will never sell or trade your data to third parties for marketing purposes. We may share your data if required to comply with applicable laws and regulations.
4. Data Retention
When you place an order through the Site, we will maintain your Order Information for our records (such as tax and accounting purposes) unless and until you ask us to delete this information.
